รัฐบาลต้องปฏิบัติตามหลักจารีตประเพณีระหว่างประเทศ ไม่ส่งผู้สื่อข่าวร่วมงาน Democratic Voice of Burma ต้องยุติการคุกคามเสรีภาพสื่อในประเทศ


ผมรู้สึกกังวลเป็นอย่างยิ่งต่อการจับกุมผู้สื่อข่าวและผู้ร่วมงานทั้ง 5 คนของสำนักข่าว Democratic Voice of Burma (DVB) ซึ่งมีที่ตั้งสำนักงานอยู่ในพื้นที่จังหวัดเชียงใหม่ โดยทางการไทยกล่าวหาทั้ง 5 คนว่าหลบหนีเข้าเมืองผิดกฎหมาย


ทั้ง 5 คนจะถูกนำตัวไปพิจารณาคดีที่ศาล และเพราะการระบาดของโควิด พวกเขาจะถูกกักขัง 14 วันก่อนที่จะถูกส่งตัวให้สำนักงานตรวจคนเข้าเมืองต่อไปหากศาลตัดสินว่ามีความผิด ถ้าหากว่าพวกเขาถูกส่งตัวกลับไปยังประเทศเมียนมาร์ มีความเป็นเป็นได้สูงมาก ที่พวกเขาจะต้องเผชิญกับการคุกคามต่อชีวิตและเสรีภาพ เนื่องจากการปฏิบัติงานให้กับ DVB โดยตั้งแต่มีการรัฐประหารเป็นต้นมามีผู้สื่อข่าวในเมียนมาร์ถูกคุมขังอย่างน้อย 70 คนในขณะที่มีรายงานถึงการทรมานและการฆาตกรรมผู้ถูกคุมขังโดยทหารเมียนมาร์จากแถลงการณ์ของสมาคมผู้สื่อข่าวต่างประเทศประจำประเทศไทย


ไม่ว่าผลการพิจารณาข้อกล่าวหาจะเป็นเช่นไร ทางการไทยจะต้องให้ความคุ้มครองต่อผู้สื่อข่าวและผู้ร่วมงานของ DVB และให้สิทธิที่จะพำนักในประเทศไทยชั่วคราว ตามหลัก Non-Refoulement ซึ่งเป็นหลักจารีตประเพณีระหว่างประเทศว่าไม่ให้ส่งตัวบุคคลกลับประเทศไปหากเชื่อได้ว่าเมื่อส่งกลับไปแล้วจะเผชิญกับภยันตราย รวมถึงระเบียบสำนักนายกรัฐมนตรีว่าด้วยการคัดกรอง​คนต่างด้าวที่เข้ามา​ในราชอาณาจักร ที่ไม่สามารถเดินทางกลับประเทศ​อันเป็น​ภูมิลำเนาได้


ผมคิดว่ายังมีโอกาสที่รัฐจะทำสิ่งที่ควรทำให้เป็นไปอย่างถูกต้องได้ จากการที่ศาลได้มีคำสั่งเลื่อนการพิจารณาคดีออกไป และจากคำแถลงของโฆษกกระทรวงการต่างประเทศที่สัญญาว่า ทางการไทยกำลังบูรณาการกันเพื่อหาแนวทางช่วยเหลือทางมนุษยธรรมในกรณีนี้ ผมขอย้ำว่า รัฐบาลไทยต้องปฏิบัติตามคำมั่นสัญญาที่ให้ไว้ต่อประชาคมระหว่างประเทศในครั้งนี้อย่างเคร่งครัด


การเข้าจับกุมสำนักข่าวที่ตั้งอยู่ในประเทศไทยครั้งนี้ เป็นส่วนหนึ่งของแนวโน้มที่น่าเป็นห่วงของเสรีภาพสื่อและเสรีภาพในการแสดงออกในประเทศไทย ที่กำลังถดถอยภายใต้รัฐบาล พล.อ ประยุทธ์ ในด้านเสรีภาพสื่อ ประเทศไทยในปัจจุบันนี้อยู่ที่อันดับ 137 จาก 180 ของโลก ในด้านสิทธิทางการเมือง และเสรีภาพของพลเมือง ประเทศไทยถูกจัดว่าเป็นประเทศ “ไม่มีเสรีภาพ” โดยองค์กร Freedom House


พล.อ ประยุทธ์ ในฐานะหัวหน้ารัฐบาลไทยจะต้องปล่อยตัวผู้สื่อข่าวและผู้ร่วมงานของสำนักข่าว DVB อย่างไม่มีเงื่อนไข และให้การคุ้มครองพวกเขาตามหลักกฎหมายระหว่างประเทศและกฎระเบียบภายในประเทศ รวมถึงยุติการละเมิดเสรีภาพของสื่อมวลชนและเสรีภาพในการแสดงออกอันเป็นเสาหลักของเสรีภาพอื่นๆ ทั้งปวง

[The Thai government must comply with the customary international law by not allowing journalists and associates of the Democratic Voice of Burma to return to Myanmar to face persecution and it must stop all harassment of press freedom in Thailand]


I am seriously concerned over the arrest of five journalists and associates of the Democratic Voice of Burma (DVB), an independent news organization based in Chiang Mai. Thai authorities have claimed that the five illegally entered the country.


The five will be brought to court, and because of the COVID-19 pandemic, they will be detained for 14 days before being handed to immigration authorities, if they are found guilty. If they are deported back to Myanmar, they will likely face threats to their lives and liberties because of their work with the DVB. Since the coup in Myanmar, at least 70 journalists have been detained at a time when there are reports of torture and extrajudicial killings by the junta, according to the Foreign Correspondents’ Club of Thailand (FCCT.)


No matter the accusation or the result of the trial, Thai authorities must offer protection for journalists and associates of the DVB and provide the right to temporarily remain in Thailand according to the principle of non-refoulement, a customary international law which prohibits states from transferring individuals back when there are substantial grounds for believing that the individuals would face persecution upon return, and the Regulation of the Office of the Prime Minister on the Screening of Aliens who Enter into the Kingdom and are Unable to Return to the Country of Origin.


There is still a chance for the government to do the right thing, judging from the postponement of the trial and the statement from the Spokesperson of the Ministry of Foreign Affairs that Thai authorities are coordinating to provide humanitarian solutions to this case. I urge the Thai government to strictly follow through on its promise and commitment to the international community.


The raid of a media organization based in Thailand is part of a worrying trend of deterioration of freedom of the press and freedom of expression in Thailand under the Prayut government. On freedom of the press, Thailand is now ranked 137th out of 180 countries, according to Reporters Without Border. On political rights and civil liberties, Thailand is now considered “Not Free,” according to Freedom House.


Gen. Prayut, as the head of the Thai government, must release journalists and associates of the DVB unconditionally, offer them protection according to the international law and the domestic regulation, and end all violations of freedom of the press and freedom of expression which are the foundations in which other liberties emanate from.
